Terms of Service

TinyPing is a hosted service that periodically checks network targets you configure (“monitors”), records the results, and sends notifications to the channels you configure. We may change, add or remove features. We will give at least 30 days' notice before removing a feature that materially reduces what you paid for.

• You must be at least 18 and able to enter a binding contract.
• You sign in with a third-party identity provider (currently Google). You are responsible for activity under your account and for keeping that sign-in secure.
• Information you give us must be accurate. Notify us promptly at [email protected] of any unauthorised use.

You may only configure monitors for systems you own, operate, or are authorised to monitor. You are responsible for the targets, request headers and other settings you configure, and for any consequence of our checks reaching those targets as configured. Use of the service is subject to the Acceptable Use Policy.

New workspaces receive a 7-day free trial. After the trial, continued use requires a paid subscription, billed monthly or yearly in advance, as chosen at purchase, per block of monitors at the price shown at purchase. Subscriptions renew automatically for successive terms of the same length until cancelled. Fees exclude taxes, which you are responsible for where applicable. The Billing and Refund Policy forms part of these terms.

You retain all rights to the data you submit and the results generated for your monitors (“Customer Data”). You grant us a limited licence to host, process and transmit Customer Data solely to provide, secure and support the service. Our handling of personal data is described in the Privacy Policy. Retention periods for check results are set out there and in the product.

We provide the service on a commercially reasonable efforts basis and do not offer a service level agreement. Checks may be delayed or missed and notifications may be delayed, filtered or undelivered for reasons including network conditions, third-party providers and recipient systems. To the maximum extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose. The service must not be used as the sole means of monitoring systems where a failure could cause death, personal injury or environmental damage.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising from or related to these terms. Our total liability for all claims in any 12-month period is limited to the fees you paid us for the service in that period. Nothing in these terms limits liability that cannot be limited by law.

You will indemnify us against third-party claims arising from monitors you configure without authorisation or from your breach of the Acceptable Use Policy, including reasonable legal costs.

You may stop using the service and cancel your subscription at any time. We may suspend or terminate your access, with notice where practicable, if you materially breach these terms or the Acceptable Use Policy, if required by law, or to protect the service or others. On termination we delete Customer Data in line with the Privacy Policy.

We may update these terms. For material changes we will notify account owners by email at least 30 days before they take effect. Continued use after that date means you accept the updated terms.

These terms are governed by the laws of Malaysia. The courts of Kuala Lumpur have exclusive jurisdiction, except that either party may seek urgent injunctive relief in any competent court. Mandatory consumer protections in your country of residence are not affected.
